1. Acceptance of Terms

By creating an account or using Quick Podcast Studio ("QPS", "the Service", "we", "us", or "our") you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms do not use the Service.

2. Description of Service

Quick Podcast Studio is a web-based AI-powered podcast production platform that enables users to generate podcast scripts, audio, video, and SEO content using third-party AI services including Anthropic Claude and ElevenLabs. The Service operates on a subscription basis with multiple pricing tiers. Users on DIY plans are required to provide their own API keys for third-party services.

3. User Accounts

• You must be at least 18 years of age to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate and complete information when creating your account
• You may not share your account with others or create multiple accounts

4. API Keys and Third-Party Services

DIY plan users must provide their own API keys for Anthropic and ElevenLabs. By providing these keys you acknowledge and agree that:

• You are solely responsible for all charges incurred through your API keys
• You must never share your API keys with anyone including Quick Podcast Studio staff
• Quick Podcast Studio stores your API keys locally in your browser and does not transmit them to our servers
• You are responsible for setting appropriate spending limits on your API accounts
• Quick Podcast Studio is not liable for any unauthorized charges resulting from compromised API keys

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on the intellectual property rights of others
• Generate spam, misinformation, or deceptive content
• Attempt to reverse engineer, copy, or redistribute the Service or its underlying code
• Use automated means to access the Service beyond normal use
• Resell or sublicense access to the Service without written permission

6. Intellectual Property

Quick Podcast Studio and all its content, features, and functionality including but not limited to the software, design, text, graphics, and logos are owned by Quick Podcast Studio and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying code without express written permission from Quick Podcast Studio.

7. Content You Generate

You retain ownership of the podcast content you generate using the Service. By using the Service you grant Quick Podcast Studio a limited license to process your content solely for the purpose of providing the Service to you. You are solely responsible for ensuring that content you generate and publish does not infringe on third-party rights or violate applicable laws.

8. Subscriptions and Billing

• Subscriptions are billed monthly in advance
• All payments are processed securely through Stripe
• You may cancel your subscription at any time through your dashboard
• Cancellation takes effect immediately and you will be moved to the free trial tier
• We do not offer refunds for partial billing periods
• We reserve the right to change pricing with 30 days notice

9. Affiliate Program

Quick Podcast Studio operates an affiliate program through Rewardful. Affiliate commissions are paid at our discretion and subject to the following conditions:

• We reserve the right to modify, suspend, or terminate the affiliate program at any time without notice
• Commissions are not guaranteed and are subject to verification and approval
• Quick Podcast Studio is not liable for unpaid commissions in the event of service discontinuation, fraud, or violation of these terms
• Participation in the affiliate program constitutes acceptance of these terms

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind either express or implied. Quick Podcast Studio does not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content may contain inaccuracies. You are responsible for reviewing and verifying all content before publishing.

11. Limitation of Liability

To the maximum extent permitted by law, Quick Podcast Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, data, or goodwill arising from your use of the Service. Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms of Service. You may terminate your account at any time through your dashboard settings.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms of Service are governed by the laws of the State of New York without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Schenectady County, New York.
